AGREEMENT AND RELEASE OF LIABILITY
In consideration for being permitted to use the facilities and equipment of Curt Graham, The Cross Roads Wind Sports and its employees, and to engage in the sport of Hang Gliding, including but not limited to: equipment use/rental, ground instruction, solo and two-place flight instruction, solo and two-place mountain launching, all types of towing including platform, static and aero-towing, flight simulators, tethered platform simulators, trips, tours, seminars, competitions, and related activities (hereinafter collectively referred to as “HANG GLIDING ACTIVITIES”), I ________________________________________, hereby agree as follows: I hereby RELEASE AND DISCHARGE (initial here _________) the United States Hang Gliding Association, Curt Graham, The Cross Roads Wind Sports and its employees, instructors, pilots, and the owners of the equipment and land used for Hang Gliding Activities (herein collectively referred as the “Released Parties”), from any and all liability, claims, demands, or causes of action that I may hereinafter have for injuries or damages arising from my Hang Gliding Activities, including but not limited to, losses CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES (initial here __________).
2. I further agree that I WILL NOT SUE OR MAKE A CLAIM against the Released Parties for injuries, damages or other losses sustained as a result of my participation in Hang Gliding Activities (initial here __________).
3. I understand and acknowledge that Hang Gliding Activities have inherent dangers that no amount of care, caution, instruction or expertise can eliminate, and I EXPRESSLY AND VOLUNTARILY ASSUME ALL RISK OF DEATH OR PERSONAL INJURY SUSTAINED WHILE PARTICIPATING IN HANG GLIDING ACTIVIES WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES (initial here _________).
4. I have been advised and recognize that my Hang Gliding Activities are not covered by personal accident or general liability insurance policies issued to Curt Graham or any other of the Released Parties (initial here _________).
5. I hereby expressly recognize that this Agreement and Release of Liability is a contract pursuant to which I have released any and all claims against the Released Parties (initial here _________).
6. I also understand and acknowledge that Hang Gliding lesson packages are contractual and not refundable (initial here _________).
In consideration of the permission granted to me to participate in the Hang Gliding activities, I do hereby, for myself and my heirs, administrators and assignees, release, remise, and discharge Curt Graham and The Cross Roads Wind Sports and its employees of and from any and all claims, demands, and causes of action of any sort or for injuries sustained to my person and/or property (initial here _________).
I UNDERSTAND THAT I AM GIVING UP MY RIGHT TO SUE OR BRING CLAIMS AGAINST ANY OF THE ABOVE PERSONS ON ACCOUNT OF THEIR NEGLIGENCE OR THE NEGLIGENCE OF ANY OTHER PERSON IF I AM INJURED IN ANY WAY BECAUSE OF MY PARTICIPATION IN HANG GLIDING.
I AM EXPRESSLY ASSUMING THE RISKS INVOLVED IN MY PARTICIPATION IN HANG GLIDING, AND AM PARTICIPATING VOLUNTARILY AND WITH KNOWLEDGE OF THIS RELEASE AND OF THE POTETIAL RISKS OF DAMAGES AND INJURIES I AM ASSUMING.
I HAVE READ THIS AGREEMENT AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS CONTENTS, AND SIGN IT OF MY OWN FREE WILL.
